2. Scope of Work
2.1 The Company agrees to carry out the Services as described in the accepted quotation.
2.2 Any major unforeseen repairs (e.g., substrate or framework damage) may be charged as extras, subject to Client approval.
2.3 The Company reserves the right to suspend or delay work if unsafe conditions, weather, or access
3. Client Responsibilities
3.1 The Client must provide safe, clear, and reasonable access to the Site.
3.2 The Client must ensure that:
- Power and water are available during work hours.
- Pets, children, and other individuals are kept away from the work area.
3.3 The Client is responsible for any damage or delay caused by failure to meet these
4. Materials and Workmanship
4.1 All materials used will be of high quality and suitable for fibreglass pool resurfacing.
4.2 The Company warrants its workmanship for a period of [5 years] from the completion date, subject to clause 7. (Warranty Conditions).
4.3 Colour variations, minor texture differences, or gloss level changes may occur over time due to material or environmental factors and are not considered defects.
5. Payment Terms
5.1 A deposit of 0% is required upon acceptance of the quotation.
5.2 The balance is due upon completion of the Services unless otherwise agreed in writing.
5.3 Payments must be made by EFT, credit card, cash.
5.4 Interest of 2% per month may be charged on overdue amounts.
5.5 The Company retains ownership of all materials until full payment is received
6. Delays and Weather
6.1 Fibreglass resurfacing is weather-dependent. Rain, humidity, or temperature may affect scheduling and curing times.
6.2 The Company is not liable for delays caused by weather, supply shortages, or other factors beyond its control.
6.3 Rescheduled work will be completed as soon as practical.
7. Warranty Conditions
7.1 This warranty covers peeling or delamination of the new fibreglass surface due to workmanship or material defects over a 5 year period from completion date.
7.2 The warranty is void if:
- The pool is not properly maintained (e.g., unbalanced water chemistry and misuse of chemicals)
- Physical damage occurs (e.g., impacts, misuse, structural movement)
- Repairs or modifications are made by others without written approval.
7.3 The Company’s liability is limited to repair or replacement of the defective surface only.
7.4 Consequential or incidental damages are covered.
7.5 Warranty does not include reoccurring osmosis, cracking due to poor structural supports or pre-existing drainage issues
7.6 Warranty does not include structural movement resulting in product damage.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, the Company is not liable for indirect, incidental, or consequential losses arising from the Services.
8.2 The Client agrees to indemnify the Company against any claim arising from misuse or alteration of the resurfaced pool.
8.3 Although all considerations are taken during the repair of every pool undertaken- ect bracing, weather conditions , HSV management, safe removal of water and coverings- although unlikely a very low risk of unforeseen damage may arise due to the removal of the water and May result in movement of the pool. Recoat Pool Renovations is not liable for any damages in this instance.
9. Termination
9.1 Either party may terminate the agreement if the other party breaches its obligations and fails to remedy within 7 days of written notice.
9.2 The Company may charge for work completed, materials purchased, and reasonable demobilisation costs up to the date of termination
10. Governing Law
This agreement is governed by the laws of the state of Queensland and both parties submit to the jurisdiction of its courts
11. Acceptance
By signing below, the Client agrees to these Terms and Conditions.
